Different and practical views on planning and drafting to both help clients and protect practitioners will be presented. There are many ways you can address divorce in a SLAT plan: Do nothing e.g. non-reciprocal SLATs; Remove spouse beneficiary post-divorce; Use a floating spouse clause; Split a SLAT with ½ a floating and ½ not; SPAT; DAPT or hybrid DAPT; and more. Practitioners can protect themselves when doing SLAT-Like plans: by presenting the client with drafting options, use careful retainer agreement provisions, and use protective memorandum.
