Art and Collections in Estate Planning
This webinar will discuss the integration of art and collectible assets into sophisticated estate planning, focusing on the challenges these assets present due to their often undocumented, undervalued, and informally managed nature. It addressed how collections evolve from personal acquisitions driven by passion into significant asset classes requiring coordinated legal, tax, and valuation planning. Topics included identifying the full scope of collectible assets, creating comprehensive inventories, assembling provenance and ownership documentation, and obtaining appropriate appraisals based on purpose. The program also explores ownership structuring, fiduciary administration issues, and the complexities introduced by multi-jurisdictional holdings. Additional discussion cover charitable planning considerations, including institutional acceptance and timing, as well as succession challenges such as divisibility, liquidity, and family dynamics. Early communication with heirs, aligning collector intent with beneficiary capabilities, and coordinating among professional advisors to mitigate risks, reduce inefficiencies, and avoid disputes in the administration and transfer of these unique assets.
Speakers: Juliette Yuan, JY&A Fine Art Advisory and Appraisal, and Martin Shenkman, Esq.
