Considerations in Co-Counseling with an Elder Law and Special Needs Attorney

Elder law and special needs (ELSN) planning is a specialized area of the law, but one that trust and estate planning (T&E) attorneys frequently encounter. In many cases, even skilled estate planners may benefit from collaborating or co-counseling on complex ELSN matters for clients. Co-counseling can lead to more thorough, effective planning for the many clients facing special needs planning challenges. Clients gain confidence knowing they are receiving well-rounded, expert advice from their team. How can financial advisers, general estate planning attorneys, CPAs, and others in the allied professions identify circumstances that might suggest specialized expertise is needed? What planning issues might be more nettlesome than initially anticipated? Statistics demonstrate how critical this is for many clients. By 2033, 20% of Americans will be 65 or older and it is estimated 70% will need some form of long-term care (LTC). More than 56 million Americans are living with a disability: mental, cognitive, or physical. That is 19% of U.S. population! 1 in 6 (or about 17%) of children ages 3 to 17 have one or more developmental disabilities.
