Income Tax Considerations and Elections in Estate Administration
This webinar provides a comprehensive and highly practical analysis of income tax considerations and strategic elections in estate and trust administration, focusing on critical decisions that can materially impact tax outcomes for estates, trusts, and beneficiaries. The program addresses key issues surrounding the final Form 1040, including the allocation of income and deductions before and after death, the treatment of jointly held and payable-on-death assets, and the handling of tax attributes such as passive losses and carryovers that may expire at death. It then explores essential elections, including the Section 454 election for U.S. savings bond interest and elections related to medical expenses, illustrating how thoughtful timing can produce meaningful tax savings across different taxpayer brackets. The session also examines fiduciary income tax return planning under Form 1041, including the selection of fiscal year, Section 645 election, 65-day rule, property distribution elections under Section 643(e)(3), and strategies for optimizing deductions between income tax and estate tax returns. Particular attention is given to emerging issues such as the new 2/37ths limitation on itemized deductions and its potential effect on charitable deductions and DNI planning, raising important considerations for structuring distributions and managing compressed trust tax brackets.
